Scientology Escalates DC Protester To Martyr Status

WWP ~ What started off with an ex-Scientologist voice his opinion in front of the Washington DC Scientology building has escalated into an all-out legal battle with Scientology corporation's top lawyer, Kendrick Moxon, taking on the 1st Amendment's right of free speech VIA a trumped-up stalking charge to silence the critic, AnonSParrow.

This is nothing new in Scientology's legal bag 'o tricks to discourage critics from airing their opinions, especially when it starts affecting Scientology's bottom line. In fact, Hubbard, Scientology's founder, even wrote a policy on it:
"The purpose of a lawsuit is to harass and discourage rather than
to win.... Don't ever defend. Always attack.
Find or manufacture
enough threat against them to cause them to sue for peace. Originate
a black PR campaign to destroy the person's repute and to discredit
them so thoroughly they will be ostracized..."

"The law can be used very easily to harass, and enough harassment on somebody who is simply on the thin edge anyway, will knowing that he is not authorized, will generally be sufficient to cause his professional decease. If possible, of course, ruin him utterly."

• [JUL/10] AnonSParrow subtly "threatened/assaulted" by Scientologist in front of building. Police are flagged down. Complaints are ignored. Chanologists upset by lack of response, contact DC Police. DC Police forced to look into matter and Officer 3915's inaction.
• [JUL/10] AnonSParrow has conversation with investigating DC Police outside Scientology's DC building about Kim Bellotte's stalking report, and receives TRO info.
• [JUL/10] "AnonSParrow: I did file a police report that included the shooty mcshooter/camera grab, "V for Vendetta/we're going to kill you", and "things start to happen after dark"/fist pump.
When the police officer left my apartment on Monday (after viewing the aforementioned video parts), she said she was heading over to the org. to find this guy and tell him he cannot be touching me or gesturing in that manner anymore.
I told her that I wasn't sure if he would be there at that moment and she said if he isn't then she will go back until she finds him."

The term is often applied to those whom the Church of Scientology perceives as its enemies, i.e. those whose "disastrous" and "suppressive" acts are said to impede the progress of individual Scientologists or the Scientology movement.

[text][video] The original hearing was to include just AnonSParrow, Kim Bellotte and the residing judge. At 10:00 am of the day of the hearing (scheduled for 3:00 pm), Kendrick Moxon (Kim Bellotte is now retaining Scientology's lead lawyer) drops off thick pack of additional evidence. At the meeting, "...the judge asks me if I'm representing myself or if I want an attorney. I explained to him that in the original complaint Kim Bellotte said she would be representing herself so I planned on representing myself but then Mr. Moxon showed up at my apartment with the evidence so I was caught off guard."
Judge sees through railroading of accused, grants postponement of hearing till August 12th, to Moxon's dismay. Also agreed upon is AnonSParrow's unwritten agreement that he and Belotte would stay away from each other until that time (no protests at Scientology's DC building). [document]
• [AUG/10] Fellow DC protesters fill the void created by AnonSParrows absence, by protesting a recruitment event BBQ at Scientology's building, thus hampering their recruitment attempts once again.
• [AUG/10] Multiple auctions (still ongoing) started to help AnonSParrow out with his upcoming lawyer expenses. [see this section at WWP for ongoing auctions]
• [AUG/10] "...Brian Mandigo AKA Sparrow has been notified to turn himself in to face criminal charges no later than AUG-5-2010. The DC Police Department has decided to present Kim Bellotte's complaint of stalking to a prosecutor and they found cause to have a warrant issued for his arrest..."
• [AUG/10] ACLU contacted. Not interested in dealing with the criminal part of this case, "...Our attorneys are experienced civil litigators, but criminal cases involve an entirely different set of procedural rules and, broadly speaking, require a different sort of expertise. Because of this divide, the ACLU exclusively litigates civil actions, while other organizations (such as public defender services) specialize in criminal defense..."

Examples of Scientology's Legal History:
• 1977 Kendrick Moxon: was named as an unindicted co-conspirator after the Federal Bureau of Investigation's investigation into criminal activities by Scientology operatives called "Operation Snow White".

• 2009 LasVegas Swat Gets Duped By Scientology Lawyers: Justice of the Peace Eric Goodman on Thursday ordered Metro Police to return everything they seized in a midnight raid last month at the Las Vegas home of anti-Scientologist Colby Schoolcraft.

• 2008 Gregg Housh: Housh had registered his name with the city of Boston as the protest permit holder, and the Scientology organization obtained his name by requesting it from the city. Shortly afterwards, Housh was served with charges of trespassing, criminal harassment, and months later disturbing the peace and disturbing religious worship.
The charges were proven to be false and fabricated.
On October 23, 2008, the Church of Scientology issued a press release incorrectly stating that Housh was a "self-proclaimed leader" of a local cell of a terrorist group called "Anonymous".After passing through the courts of four separate judges, Judge Thomas C. Horgan issued a one-year "continuance without a finding," effectively dismissing the charges.

• 1990's Keith Henson: declared bankruptcy in response to the judgment. Henson began protesting Scientology regularly, standing outside of Scientology's Gold Base, with a picket sign. The organization sought to obtain a restraining order, which failed.
As a result of this conflict, Henson was charged with three misdemeanors under California Law: making criminal threats, attempting to make criminal threats and threatening to interfere with freedom to enjoy a constitutional privilege.
Sheriff’s Detective Tony Greer, Riverside County lead investigator, said: "In reviewing all of the Internet postings I did not see any direct threat of violence towards the church or any personnel of the church."
The jury verdict of the trial resulted in Henson being convicted of one of the three charges: "interfering with a religion."

    The request for a Temporary Restraining Order by Kim Belottr against Mandigo is scheduled for Friday August 13, 2010, before Judge Judith Macaluso. I have confirmed with the law clerk.
