DC Protest: AnonSParrow Legal Update No.2 [video]

WWP ~ A video update was posted on YouTube by anonSParrow giving an oral report of what has happened thus far and which direction his legal Scientology snafu is leading.

The site link he mentions in the video is www.dccourts.gov and his instructions are: Search for my name, Brian Mandigo, for court details.

This is primarily a recap aimed at those who don't want to search through all the TL;TR on WWP (or on here) and want a quick synopsis of his situation.
But there are a few new details (and props) peppered throughout the report.

anonSParrow: DC Legal Update No.2 [recap]

Fight the Power (original) ~ Isley Brothers (1975)
"Law enforcement is necessary. As a species we haven’t evolved past needing that. Fight the Power is not about fighting authority. it’s not that at all. It’s about fighting abuse of power.[2]"

Scientology VS DC Protester: Escalating Timeline [cont/video]

anonsparrow free speech washigton dc scientology
Scientology Can't Even Clear A Sidewalk, Never Mind A Planet
washington dc scientology police call
WWP ~ Scientologists continue to harass protesters in front of their building in Washington DC and as you can see in the video, they don't vary from their TECH on how to discourage critics. Also, remember, these are the (self-professed) most ethical people on the planet.
• Quote a law that doesn't exist (filming in public).
• Use calling police authorities as a threat.
• Question protester's motives (usually, they would first ask the protester why he's hiding his face behind a mask, but RP doesn't wear one).
• Ask if they're doing it, why are they doing it in that spot (as opposed to another location) and do it in a more productive way (lolwut?).
• Give false report to police (stating the protester was on their property).
[radiopaul] Scientology Protest DC 8-26-2010 [part 1]

Note: Ken Moxon (Kim Belotte's lawyer) arrives in DC and makes a brief appearance in the last few moments of Part 3, luggage in tow.

← back • The Escalation Timeline • fwd →
• [AUG/27/10] AnonSParrow: So I had the status hearing today before Judge Macaluso. This takes the place of the original October 22 status hearing.
Moxon was there along with Kim Belotte, Sylvia Stanard and Vicki Turissi. Also, a surprise appearance by this Scientologist from Philly (Bruce Thompson). Why they would bring him to a status hearing (or at all) is beyond me.

So anyway, what happened today:
The judge said it was a moot point to pursue a TRO because the criminal complaint already enforces the stay away order. Moxon once again pressed the issue that if the criminal charges were dropped (for whatever reasons beyond his control) then it would be necessary to have this TRO to keep me away.
The judge told him that he is NOT getting the TRO and that should the criminal charges "go away", for whatever reason, then he can request an emergency hearing and one will be granted within 48 hours. So he said ok.
Then Moxon asked the Judge for permission to submit an amended complaint which she granted. She also granted my lawyer permission to submit a revised answer.
Moxon has until September 26 (iirc) to submit his and we have until October 15 to submit our answer.
The judge then set the upcoming trial events/hearings to be scheduled on what's called "Track 2" which is a medium pace for proceedings. My lawyer is going to forward that schedule to me but I don't think anything happens in the civil case now until late September.
The criminal case is set to begin with a similar status hearing like today's on September 10.

So that's all I've got for now. I will say that I like the judge so far. She seems like she is a no-nonsense/all-business kind of person. And in my opinion that is exactly what is needed in this case.

Take Down Of A Take Down...Of A Take Down
And since Kendrick Moxon's name came up in today's post, let's continue to look into what some are trying to eliminate from the public's view. Of course, we know, once something goes up on the the internet, it never goes away.

Below is a soundtrack of a video-blogger who posted a mirror of Gerry Armstrong's opinion of Kendrick Moxon and then found it removed through a TOS violation. Note: the video-blogger's original video, where the soundtrack originated, (I believe) was taken down with a TOS violation also. Listen in, and you be the judge if it rates a violation.

Washington DC Org Attempts More 'Chilling Effect' On Protesters [video]

anonsparrow free speech washigton dc scientology
Scientology Protest Washington DC org WWP ~ While AnonSParrow is side-lined from protesting at Scientology's Washington DC IdleOrg because of pending legal restrictions, another member of Anonymous, RadioPaul, has risen to take his place voicing his opposition of the church's corporation's unethical operations.

One of the reasons Scientology is trying to stifle the protesting at one of their newer flagship Orgs is the demonstrators, along with discouraging newer recruits from joining, are documenting and broadcasting the fact that this organization is lying to their members and the press as to their booming stats and numbers. Well, needless to say, they are none to pleased at this situation.

In RadioPaul's latest video, we find a couple of 'SeaOrg'ers attempting to discourage said protester from filming the goings on at their particular Hubbardville meeting house. This time they use the don't film my child statement in an attempt to chill the effect of the videographer. But thanks to the magic of floating gray boxes, the youngster could be David Miscavige for all we know (he's a little short) and the supposed mother's uncanny rant still gets worldwide coverage.

Update: Second video angle (thanks subgenius): YouTube ~ Scilons Trying to Set Up Radio Paul

One comment on WWP sums it up nicley:
No public, no new people are interested, and the staff is going bannanas because their stats are in the crapper. The whole baby thing is too much. If you didn't want someone to see your baby, you obviously wouldn't get in their face and pester them with the kid in the dang stroller. Do they really think they are going to accomplish something? LOL.
YouTube - [radiopaul] Scientology Protest DC 8-24-2010

Hubbard Never Met Streisand
Also, as a sidenote: You'd think by now Scientologists would have figured out, when you speak into a protester's camera, there's a chance you could be speaking to the world. Anonymous is a worldwide UN-organization with worldwide broadcast capabilities. But then again, Hubbard never even mentioned the internet in any of his teachings, so how dangerous could it be to Scientology's existence?

Scientology VS DC Protester: Escalating Timeline Continued

• [AUG/13] A T.R.O. wasn't necessary because I already need to stay away based on the conditions of my release from jail in the criminal complaint
• [pending] There will now be a status hearing before Judge Macaluso on Friday August 27. She is also the judge who will hear the case in its entirety starting Friday September 10.

ODIT had been putting off the timeline update till there was something earth shattering to report. Well, that never happened. We're stuck in a holding pattern like one of Xenu's DC-8's waiting for a landing spot at the volcano.

But, in the meantime, some more background video popped up over at WWP on Sylvia Stanard, currently the Director of Washington DC Public Affairs, from 1997 when she was, supposedly, a reporter for Scientology's Freedom Magazine at a anti-scientology press conference at the Holiday Inn (Clearwater, FL) before a protest at the Ft. Harrison Hotel. How she can be a objective reporter while at the same time answering questions as a spokesperson is beyond me.
Thanks to Smurf(above) and Jeff Jacobsen(below) for the history lesson (but the dates are are a little fuzzy).
This was our first press conference in Clearwater in conjunction with the first protest. We had 18 protesters. I believe this was March of 1996, just months after Lisa McPherson died there (though we didn't know it at the time).

[Kendrick]Ken Moxon [the Scientology lawyer currently involved in AnonSParrow's litigation], Mike Rinder, Brian Anderson, and 2 other Scientologists tried to crash the press conference, but we had hired an off-duty cop to help us at the door. they went away mumbling about holding their own press conference (which they did in subsequent years).

We had a debate about whether to let in the Freedom Magazine "reporters" but in the end decided it would be ok. They did not disrupt the press conference but did try to control the Q&A after.

I [Jeff] was MC, Dennis Erlich, Paul Grosswald, and others spoke. We had a good media presence and got good local coverage.
Sylvia Stanard Defends Scientology's 'Fair Game' Policy
Excepts of the documents they were speaking of can be viewed at xenu-directory.net's archive along with more multimedia on the the subject.

Kendrick Moxon: Intentionally Interrupts TV Interview
And just because his name keeps coming up, posted below is a video of Moxon interrupting a 1996 interview with ex-Scientologist Dennis Erlich. The attorney intentionally approached Dennis Erlich (the original scientology wikileaker before there was Wikileaks) forcing a violation of a restraining order that he [Moxon] had filed for in the first place!

Example of Scientology's 'Fair Game' History:

Example of Scientology's PSYCHO-TERROR History:
paulette cooper 1967 Paulette Cooper's conflict with the Church of Scientology began in 1970 when the Church filed suit against her in British court for an article she wrote that was published in London's Queen magazine. An expansion of this, her first book, The Scandal of Scientology, came out in 1971; it was a critical exposé of the activities and beliefs of the Church of Scientology.

The book earned her more negative attention from members of the Church, and that same year saw a second lawsuit filed in Los Angeles Superior Court against her by the church. Further lawsuits and countersuits followed throughout the years, totaling nineteen suits from all over the world that Scientology instituted against Cooper, and three counterclaims that she instituted.

scandal of scientologyThrough the years as she continued to expose the Church, Paulette Cooper was the target not only of litigation but of several harassment campaigns including a Scientology campaign known as Operation Freakout, the goal of which was to deter Cooper from criticism of Scientology by having her "incarcerated in a mental institution or jail or at least to hit her so hard that she drops her attacks." In a previous campaign titled Operation Dynamite the church sent itself forged bomb threats, purportedly from Cooper, using her typewriter and paper with her fingerprints on it; further plans included bomb threats to be sent to Henry Kissinger. The Church's campaign was discovered when the FBI raided Scientology offices in 1977 and recovered documents relating to the operation. The Church finally agreed to an out-of-court settlement with Cooper in 1985 in exchange for her discontinuing her legal actions against Scientology.

Scientology Escalates DC Protester To Martyr Status

anonsparrow free speech washigton dc scientology
anonsparrow suppressive declare
WWP ~ What started off with an ex-Scientologist voice his opinion in front of the Washington DC Scientology building has escalated into an all-out legal battle with Scientology corporation's top lawyer, Kendrick Moxon, taking on the 1st Amendment's right of free speech VIA a trumped-up stalking charge to silence the critic, AnonSParrow.

This is nothing new in Scientology's legal bag 'o tricks to discourage critics from airing their opinions, especially when it starts affecting Scientology's bottom line. In fact, Hubbard, Scientology's founder, even wrote a policy on it:
"The purpose of a lawsuit is to harass and discourage rather than
to win.... Don't ever defend. Always attack.
Find or manufacture
enough threat against them to cause them to sue for peace. Originate
a black PR campaign to destroy the person's repute and to discredit
them so thoroughly they will be ostracized..."

"The law can be used very easily to harass, and enough harassment on somebody who is simply on the thin edge anyway, will knowing that he is not authorized, will generally be sufficient to cause his professional decease. If possible, of course, ruin him utterly."
~ A Manual on the Dissemination of Material (1955) by L. Ron Hubbard.[original]

• [unknown] AnonSParrow quits Scientology.
• [DEC/08] AnonSParrow begins video documentation of his demonstrations in front of Scientology's (former) DC building.
• [OCT/09] Scientology moves to new building
• [unknown] Note: During this time AnonSParrow develops a following on YouTube. Also, bringing to the public eye how Scientology's ever-expanding numbers are just a deluded pipe-dream designed to bolster their recruitment.
• [JUL/10] AnonSParrow subtly "threatened/assaulted" by Scientologist in front of building. Police are flagged down. Complaints are ignored. Chanologists upset by lack of response, contact DC Police. DC Police forced to look into matter and Officer 3915's inaction.
• [JUL/10] AnonSParrow has conversation with investigating DC Police outside Scientology's DC building about Kim Bellotte's stalking report, and receives TRO info.
• [JUL/10] "AnonSParrow: I did file a police report that included the shooty mcshooter/camera grab, "V for Vendetta/we're going to kill you", and "things start to happen after dark"/fist pump.
When the police officer left my apartment on Monday (after viewing the aforementioned video parts), she said she was heading over to the org. to find this guy and tell him he cannot be touching me or gesturing in that manner anymore.
I told her that I wasn't sure if he would be there at that moment and she said if he isn't then she will go back until she finds him."

• [JUL/10] AnonSParrow issued a copy of a Suppressive Declare [goldenrod] by Scientology. The term is often applied to those whom the Church of Scientology perceives as its enemies, i.e. those whose "disastrous" and "suppressive" acts are said to impede the progress of individual Scientologists or the Scientology movement.
• [Jul/10] AnonSParrow: "...Ok so I was served (sort of) today at a protest. It's actually a notification about a hearing on Monday for the request for a TRO. I can go if I want. (I want.) ..."
AnonSParrow: "...I don't know if this happened or not but I suspect it did and that the TRO thing by Kim was in direct response to this enturbulation (police report)..."
• [JUL/10] Enter Kendrick Moxon:
[text][video] The original hearing was to include just AnonSParrow, Kim Bellotte and the residing judge. At 10:00 am of the day of the hearing (scheduled for 3:00 pm), Kendrick Moxon (Kim Bellotte is now retaining Scientology's lead lawyer) drops off thick pack of additional evidence. At the meeting, "...the judge asks me if I'm representing myself or if I want an attorney. I explained to him that in the original complaint Kim Bellotte said she would be representing herself so I planned on representing myself but then Mr. Moxon showed up at my apartment with the evidence so I was caught off guard."
Judge sees through railroading of accused, grants postponement of hearing till August 12th, to Moxon's dismay. Also agreed upon is AnonSParrow's unwritten agreement that he and Belotte would stay away from each other until that time (no protests at Scientology's DC building). [document]
• [AUG/10] Fellow DC protesters fill the void created by AnonSParrows absence, by protesting a recruitment event BBQ at Scientology's building, thus hampering their recruitment attempts once again.
• [AUG/10] Multiple auctions (still ongoing) started to help AnonSParrow out with his upcoming lawyer expenses. [see this section at WWP for ongoing auctions]
• [AUG/10] "...Brian Mandigo AKA Sparrow has been notified to turn himself in to face criminal charges no later than AUG-5-2010. The DC Police Department has decided to present Kim Bellotte's complaint of stalking to a prosecutor and they found cause to have a warrant issued for his arrest..."
• [AUG/10] ACLU contacted. Not interested in dealing with the criminal part of this case, "...Our attorneys are experienced civil litigators, but criminal cases involve an entirely different set of procedural rules and, broadly speaking, require a different sort of expertise. Because of this divide, the ACLU exclusively litigates civil actions, while other organizations (such as public defender services) specialize in criminal defense..."
• [AUG/10] AnonSParrow retains criminal defense attorney.

Lawyer Gives Speech on Scientology's Abuse of the US Legal System [Part 1]
Graham Berry, long time activist/lawyer speaks at a conference about Scientology's abuse of critics. Sept 4th 08 Hamburg, Germany. Part [2-3-4-5]

Examples of Scientology's Legal History:
• 1977 Kendrick Moxon: was named as an unindicted co-conspirator after the Federal Bureau of Investigation's investigation into criminal activities by Scientology operatives called "Operation Snow White".

• 2009 LasVegas Swat Gets Duped By Scientology Lawyers: Justice of the Peace Eric Goodman on Thursday ordered Metro Police to return everything they seized in a midnight raid last month at the Las Vegas home of anti-Scientologist Colby Schoolcraft.

• 2008 Gregg Housh: Housh had registered his name with the city of Boston as the protest permit holder, and the Scientology organization obtained his name by requesting it from the city. Shortly afterwards, Housh was served with charges of trespassing, criminal harassment, and months later disturbing the peace and disturbing religious worship.
The charges were proven to be false and fabricated.
On October 23, 2008, the Church of Scientology issued a press release incorrectly stating that Housh was a "self-proclaimed leader" of a local cell of a terrorist group called "Anonymous".After passing through the courts of four separate judges, Judge Thomas C. Horgan issued a one-year "continuance without a finding," effectively dismissing the charges.

• 1990's Keith Henson: declared bankruptcy in response to the judgment. Henson began protesting Scientology regularly, standing outside of Scientology's Gold Base, with a picket sign. The organization sought to obtain a restraining order, which failed.
As a result of this conflict, Henson was charged with three misdemeanors under California Law: making criminal threats, attempting to make criminal threats and threatening to interfere with freedom to enjoy a constitutional privilege.
Sheriff’s Detective Tony Greer, Riverside County lead investigator, said: "In reviewing all of the Internet postings I did not see any direct threat of violence towards the church or any personnel of the church."
The jury verdict of the trial resulted in Henson being convicted of one of the three charges: "interfering with a religion."

Scientology Protests / Coast to Coast [video]

No. Not the radio show. Two separate Scientology protests on two different coasts popped up in the news over at WWP this morning.Videos of both are provided.

anonsparrow free speech washigton dc scientology

No.1: AnonSparrow assault in Washington DC

officer 3915 washington dc The following email that was forwarded to the DC Internal Affairs Metro Police about the protest in the video below sums up what happened nicely:
I would like to report officer 3915 for refusing to file a report concerning an assault on a protester. The victim was approached by a Scientologist exiting the Scientology building making gun gestures towards the protester.

Then, the same Scientologist moved within the protester's personal space and aggressively grabbed his videocamera, trying to take it away from the protester. After finally letting go of the protester's videocamera, the scientologist then proceeded to question the protester about military service while grabbing the protester's dogtags and trying to pull those off.

This is clearly aggressive behavior that is by law, assault. The officer watched a witnesses videotape and dismissed it with no valid reasons. The officer went on to mock the protester's claim that he would put the video on the internet by saying that he would be surprised if anyone watched it. By refusing to file a report, this sends the message that your department condones violent and aggressive behavior in society.

As of this e-mail, there have been hundreds of views in less than 24 hours. Officer 3915 has refused to fulfill his duty and this matter should be investigated and dealt with, in a thorough manner. The following link is a YouTube posting of the video shot by the protester and clearly shows the events that unfolded.
Read more about this at WWP and ExScn.net [update: following day > revenge protest]

Update: July17 Protest at DC Ideal Org Trailer
Looks like AnonSparrow's little kerfuffle involving his camera and the Tracy Morgan wannabe Scientologist [see above video] rilled up some local Anons into action for another protest. Hubbard's ancient rules include dead-agenting, or intimidating the attacker. Scientologists have yet learn that their 1950's technique seems to have the same effect as kicking a hornets nest in the age of the internet. At any rate, to borrow one of their phrases: Scientology, you pulled it in.

No.2: AGP & Friends at Kodak Theater, Los Angeles, Ca.

gavel
Angry Gay Pope and friends decided to test the private property/public forum ruling by the California Supreme Court by going to the Kodak Theater where Scientology was holding their Maiden Voyage 2010 OT (Operating Thetan) Event.

They had mixed results, as you can see in the two videos below. To get more insight into what transpired, visit this thread at WWP and ExScn.net

Anonymous In DC: Another Nashville? [updated]

Well, while Scientology is trying to mop-up the big mess they caused in Nashville, they're ready to do it all over again. This time in Washington DC. Today is the grand opening ceremony for the Ideal Org at 16th and P Streets NW. And just like Nashville, Anonymous is ready to greet them with a demonstration.

But it seems Scientology just can't learn from their mistakes (what do ya' want? there just homo-novi). It's been reported that they've already tried to shut the protest down through intimidation, but the protesters had the fore-sight to apply for a sidewalk permit, and informed local police of the harassment.

It's unclear if the biggest little man in Scientology, David Miscavige, will be attending, but it's been confirmed that foot-bullet marksmen such as Tommy 'i'm walking out' Davis, John 'i smell puthy' Carmichael and Scientology's in-house lawyer, Kendrick 'unindicted co-conspirator' Moxon are to be in attendance.

It's a good chance the celebration has already started by the time this post goes up, but you can follow any play-by-play action that may occur at WWP's post-raid thread. Mods will be adding updates from protesers using low-resolution/low-bandwidth platform devices [cellphones].

Update: Looks like the super-human Scientologists had to resort to big sheet shields to ward off scary basement-dwelling protesters. If you didn't know any better, you'd think Anonymous was protesting a new chinese laundry.

Post Event Update:
Apparently the reporter for the DCist had no clue as to what was going on at the protest (left before it even started), but luckily we have an amazing protester/videographer AnonSparrow who gives us the up close and personal version of what it's like to protest a Scientology event.

He and the other DC protesters must have been running on Xenu's eternal battery as noted in this entry at WWP:
"You are still up after being on the job all day? Since what ungodly time this morning? Dude, truly you have gained control over MEST to accomplish your epic achievements today...".

Also, since Officer Smart-Ass is such an attention whore, we'd thought we'd help AnonSparrow introduce him to the internet. [if anyone happened to catch a badge#, feel free to leave it in the comment section]

You can catch all the action from the Anon's that were there over at WWP's post-raid thread.

DC Scientologist Assaults Protester, Again

hubbard's 'most ethical people on the planet' developing a violent pattern
Hubbard Telescope ASSAULTED in DC
Their latest PR headline? Church of Scientology disaster response prepares for the 2009 Season.
Yep. They've got disasters , alright. PR disasters all over the planet. And the latest, yesterday, a second assault against an Anonymous protester in Washington, DC within the past three months.

Here's the low-down from Hubbard-Telescope (not her real name) herself from WWP:
"...Then, out of the blue, I see this hand come out of no where and some angry screaming Scientologist man reaching for my mask. He starts yelling "HOW DARE YOU WRITE THIS CRAP IN FRONT OF MY CHURCH" and tears off my mask, cracking it and hurting my nose and throwing it up on the landing of the church. He gets in my face pushing and hitting me, telling me he knows what I look like now and they'll come after me.

Scientologists leaving the org after course surrounded us and just watched, one woman taking pictures from the steps as he attacked me. I didn't raise my hands or defend myself or say anything besides "Taking pictures of me? Really?"

Finally, another Scientologist got between us and restrained him while I fished out my phone and called 911. He started on about "FINE! Call the police on me!" and took off. I followed him a little ways on the phone with the police, but he turned the corner and I decided to head back and wait for the cops. The rest of the Scientologists all scattered.

She describes her assailant as a "...guy is in his 50s about 5ft 8 - 5 ft 11. He has graying and balding hair and was last seen in a blue polo shirt tucked into blue jeans...". And she adds,"... I will be going through every video and every picture we ever took, I will find him, I will identify him, and I will make sure he is prosecuted...."

Update: While I was writing this, over at WWP [about pg 28 in the thread], they may have a face and a name. They're still sorting it out as of this writing.

And that is exactly how Anonymous ID'd this assailant back in April, when a protester, Ron Jeremy (not real name) was kicked by an irate scientologist. This also reported by Hubbard-Telescope:

Reinhard Koenig: wanted by DC Police for questioning "...A Scientologist named Reinhard Koenig [see photo] assaulted a NYC anon visiting in DC today. Ron Jeremy from NYC was playing music and enturbulating when the very old man came out of the Scientology building, kicked him in the shin, and walked to the corner.

When Ron Jeremy expressed his shock and outrage, the old Scientologist hurried back into the cult building. There WAS a camera rolling, but the particular camera on in that area suffered technologyfail which was the fault of no one but the camera. :( Anonymous called the police who showed up in record time to take his statement and swarmed into the CoS building to look for him. The Scios scooted the old guy out the back and he headed off down the street. Police were alerted to his fleeing the scene and tried to find him, but weren't able to spot the guy.

Scientologists claimed that Anonymous antagonized the Scios and "chased" them down the street. A well placed "I'm too fat to chase anyone" made the cops lol and pissed off the Scientology spokeswoman Sylvia Stanard. :) The cops were absolutely fantastic. They weren't able to corroborate the report since no other non-protester in the area witnessed the attack and it became a he-said he-said debate between the assaulted anon and the Scio shills.
